Criminal Responsibility Evaluations
Criminal Responsibility Evaluations ask a very important question: Was an individual criminally responsible at the time of the offense? (This is different than competency evaluations. You can read more about those here.)
In order to determine criminal responsibility, we use the legal criteria, a thorough interview, review of legal and medical records and psychological assessment.
Here’s what you can expect from a Criminal Responsibility Evaluation:
Contact with the legal team:
When we are retained by a legal team, we start by getting more information, including why the evaluation is being requested.
Interview and review of records:
An individual and legal team can expect a thorough review of the following records:
Police reports and interviews
Mental health records
Medical records
School records
Any other record that might be related to the case
Along with a records review, the forensic psychologist will also perform an extensive interview with the individual. These interviews last an average of 4 hours and sometimes we conduct a 2nd interview with follow-up questions.
Psychological Assessment & Testing:
We use validated and well-researched methods of psychological assessment to answer the question of how a person is functioning.
When we have completed the testing, interviews, and records review, we write a helpful and comprehensive report to outline our findings. This report will be provided to the legal team.
Are you an attorney?
We work with many attorneys throughout Los Angeles and Orange County to determine whether their clients meet the legal requirements for diminished capacity.
